Terms of Service

These Terms of Service ("Terms") govern your use of the website at prettymasxn.com (the "Site") and any consultations, commissions, products, and services offered by Pretty Mas By Neish LLC ("Pretty Mas," "we," "us"). By using the Site or engaging our services, you agree to these Terms. If you don't agree, please don't use the Site.

1. Parties & acceptance

These Terms form a contract between you and Pretty Mas By Neish LLC, a Delaware limited liability company with foreign-entity registration in the Commonwealth of Pennsylvania. By using the Site, submitting an inquiry, booking a consultation, or placing an order, you accept these Terms.

2. Changes to the Terms

We may update these Terms from time to time. If we make material changes, we will update the "Last updated" date and, where appropriate, provide additional notice. Your continued use of the Site after the changes become effective constitutes acceptance.

3. Eligibility & accounts

You must be at least 18 years old (or the age of majority in your jurisdiction) to engage our services. If you create an account in the future, you are responsible for keeping credentials confidential and for activity under your account.

4. Using the Site

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Site for personal, non-commercial purposes, subject to these Terms. You may not copy, scrape, mirror, reverse-engineer, or commercially exploit the Site except as expressly allowed.

5. Consultations & commissions

When you book a consultation or commission a piece:

• Scheduling. We schedule consultations Monday through Friday, 10:00 AM – 5:00 PM US Eastern. We'll confirm your requested slot by email.
• Custom work. Commissioned pieces are designed and built specifically for you. Deposits are non-refundable once work begins, because we've sourced materials and committed production time to your project.
• Timelines. Estimated timelines (6–10 weeks for carnival; 4–6 weeks for bespoke swim; 60 minutes for a styling session) are good-faith estimates. External factors (material availability, carrier delays) can affect actual delivery.
• Fittings. You agree to make yourself reasonably available for scheduled fittings. Missed or rescheduled fittings may extend timelines or affect the final fit; in extreme cases, we may convert remaining fittings to final-delivery only.
• Fit & custom alterations. Because each commission is made to your measurements and stated preferences, minor variation in fit after delivery may be addressed via paid alteration rather than return.
• Cancellation. You may cancel before work begins for a full deposit refund minus any non-refundable third-party costs already incurred. After work begins, deposits are non-refundable.

6. Orders, pricing & payment

When we offer online product sales:

• Prices, descriptions, and availability are subject to change and may contain typographical errors; we may correct errors and cancel affected orders.
• An order is not accepted until we send an order confirmation email. We may decline or cancel orders at our discretion, including for suspected fraud.
• We use third-party payment processors (for example, Stripe). By paying, you authorize the charge and agree to the processor's terms. We do not see or store full card numbers.
• You are responsible for applicable taxes and any duties levied on international shipments.

7. Shipping & delivery

We ship from the United States. Estimated delivery times are provided at checkout or in your order confirmation and are not guaranteed. Risk of loss passes to you on delivery to the carrier; claims for lost or damaged shipments should be filed with us within 14 days of the scheduled delivery date.

8. Returns, exchanges & refunds

Ready-to-wear items may be returned within 14 days of delivery, unworn, unwashed, with tags attached and the original hygiene liner intact, for a refund of the item price (shipping is non-refundable). Final-sale, bespoke, and altered items are not returnable. Bespoke and commissioned pieces are designed and built for you and are non-refundable except where required by law. Defects must be reported within 7 days of receipt; we will repair, remake, or refund at our discretion. Please email GetPretty@PrettyMasXN.com to start any return or claim.

9. Intellectual property

All content on the Site — designs, photographs, text, videos, logos, the Pretty Mas name and script mark — is owned by Pretty Mas or our licensors and is protected by intellectual-property laws. You may not use our marks without our prior written permission.

10. Your submissions

If you send us inspiration images, measurements, notes, testimonials, or other content ("Submissions"), you represent that you have the rights to share them and you grant Pretty Mas a non-exclusive, worldwide, royalty-free license to use the Submissions to provide the services you've requested. If you authorize us to use your name, likeness, or photos of you wearing our pieces in marketing (for example, by tagging us on social media with our handle), that permission may be revoked prospectively on written request.

11. Prohibited conduct

You agree not to (a) violate law or these Terms; (b) infringe others' rights; (c) submit false, misleading, or unlawful information; (d) harass, threaten, or defame anyone; (e) introduce malware or attempt to compromise the Site; (f) scrape or automate unauthorized access; (g) reverse engineer; or (h) resell or exploit the Site without permission.

12. Third-party links & services

The Site may link to or rely on third-party services (for example, Formspree, Stripe, social platforms). We are not responsible for those services and you agree to their applicable terms and policies when you use them.

13. Disclaimers

THE SITE AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THE SITE WILL BE UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SITE IS FREE OF HARMFUL COMPONENTS.

14. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PRETTY MAS, ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST REVENUE, LOST DATA, OR LOSS OF GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SITE OR OUR SERVICES IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE, OR (B) ONE HUNDRED US DOLLARS ($100). Some jurisdictions do not allow these limitations; in those jurisdictions, our liability is limited to the maximum extent permitted.

15. Dispute resolution, arbitration & class-action waiver

15.1 Informal resolution

Before starting an arbitration or lawsuit, you agree to try to resolve the dispute informally by emailing GetPretty@PrettyMasXN.com with a description of your claim. We will try in good faith to resolve the dispute within 30 days.

15.2 Binding arbitration

If informal resolution fails, you and Pretty Mas agree to resolve disputes by binding individual arbitration administered by JAMS under its Streamlined Arbitration Rules, except for: (a) small-claims-court matters within the court's jurisdiction; and (b) injunctive relief to protect intellectual-property rights. The arbitration will be seated in Wilmington, Delaware unless the arbitrator orders otherwise for your convenience, and may be conducted by phone or video. The Federal Arbitration Act governs this arbitration agreement.

15.3 Class-action waiver

You and Pretty Mas agree to bring claims only in your individual capacity, not as a plaintiff or class member in any class, collective, or representative proceeding. If this class-action waiver is found unenforceable, the entire arbitration section is void.

15.4 30-day opt-out

You may opt out of Section 15 by emailing GetPretty@PrettyMasXN.com within 30 days of first accepting these Terms, with the subject line "Arbitration Opt-Out" and your name and contact information. Opting out does not affect any other part of these Terms.

16. Governing law & venue

These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws rules. Subject to Section 15, the exclusive venue for any action not subject to arbitration is the state or federal courts located in New Castle County, Delaware, and you consent to personal jurisdiction there. We acknowledge that we also operate in the Commonwealth of Pennsylvania and will comply with Pennsylvania consumer-protection law (including 73 P.S. §§ 201-1 et seq.) to the extent it applies to Pennsylvania residents.

17. Miscellaneous

• Entire agreement. These Terms and any policies referenced here are the entire agreement between you and Pretty Mas.
• Severability. If any provision is unenforceable, the rest remains in effect.
• No waiver. Our failure to enforce a right is not a waiver of that right.
• Assignment. You may not assign these Terms. We may assign them to an affiliate or in connection with a sale or merger.
• Force majeure. Neither party is liable for delays caused by events beyond reasonable control.
• Headings. Headings are for convenience only and do not affect interpretation.
